Real Nation is a private business that delivers behavioural change and marketing services primarily in Ireland. We are committed to protecting the privacy of personal data under our control and this statement summarises our approach.

 

1 REAL NATION IS A PROCESSOR OF PERSONAL DATA

Real Nation is a Processor of personal data that is the subject matter of the services provided by us. We process this data under the instruction of our customer (normally the brand associated with the activities) and you will need to contact that organisation to exercise your rights. If you have queries, or wish to exercise your rights in relation to this personal data, you must contact the Controller.

 

2 WHERE REAL NATION IS A CONTROLLER OF PERSONAL DATA

Real Nation is a Controller of data relating to the management of contractual relations with our customers, the management of staff and other administration and operational aspects of our business. Where Real Nation is a Controller of personal data, we will clearly identify this to you at the time of obtaining that personal data.

 

While providing personal data to us in the course of business with Real Nation or using our website, we will manage your data in accordance with European and national law.

3 THE PERSONAL DATA THAT WE PROCESS AND WHY

Personal data that is the subject matter of the service provided by us

We process data on behalf of our customers while delivering our services. We are a Processor of this data. Our Customer is the Controller of this data. If you have queries, or wish to exercise your rights in relation to this data you must contact the Controller.

 

Interraction with our customers

Purpose; We obtain personal data from you to manage your organisations relationship with Real Nation. This may include your name, contact details, role, security data, or other data necessary for the management of our relationship with your organisation.

Legal basis for processing; we may rely upon our agreement with your organisation, the legitimate interest of Real Nation to provide our services,  our obligations under law or consent as a basis for processing your personal data.

 

Staff members

Purpose; We obtain personal data from you to manage your employment and in the course of fulfilling your role. This may include; name, address, contact details, PPS number, bank account details, nationality, garda vetting status and details relating to third parties such as spouse or dependants. This may also include other data in relation to your role at Real Nation.

Legal basis for processing; our contract with you, our legitimate interest to operate our business and employ members of staff, engage with contractors or engage with staff on a voluntary basis, our obligations under law, or consent as a basis for processing your personal data.

 

Direct Marketing

Purpose; We obtain personal data from you to promote Real Nation services and activities, this may include your name and contact details.

Legal basis for processing; we may rely upon the legitimate interest of Real Nation to promote services or consent as a basis for processing your personal data. Note; you can decide to opt-out of direct marketing communication at any time.

 

4 TRANSFERRING YOUR DATA TO A THIRD PARTY

We take all reasonable measures to protect your personal information while it is in our possession, however, it may be transferred to others where there is a legitimate and lawful reason. Examples of these include; Insurance providers, professional advisors, financial organisations, regulatory authorities or Revenue, for the collection or transfer of debt, IT and support providers, and electronic payment organisations.

 

In any event, personal data shall only be transferred for specific purposes that are in the legitimate interest of Real Nation, are subject to a contract with you, are in your vital interest, or are required by law. We may also transfer personal data with your consent.

 

5 WHERE YOU HAVE PROVIDED CONSENT

Where we are processing data based on your consent you may withdraw that consent at any time.

 

6 INTERNATIONAL TRANSFER

In the event that a service provider to Real Nation is international in nature, or sub processes with entities that are not within the EU, we will take steps to ensure that personal data is retained in the EU and that any further processing that may expose such data to international transfer is subject to the protections provided by a lawful basis of transfer.

 

7 INFORMATION RELATING TO CHILDREN AND VULNERABLE PERSONS

The processing of personal data relating to minors receives special attention under Data Protection Regulation and we shall treat this information with particular care. The legal age for digital consent is16 years in Ireland. Information obtained about children shall comply with the requirement for parental consent and shall receive additional consideration while planning an operational process.

 

Real Nation processes the data of children as a Processor and on behalf of our customers. Our customers are the Controller of this data. We take particular care when planning the processing of this personal data to ensure that the rights of children are protected.

 

8 SPECIAL (SENSITIVE) DATA

Real Nation recognises that it may from time to time process special categories, particularly in the context of employment and the delivery of our services. The processing of this category of information shall typically require explicit consent. We may also process special data where there is a legal/regulatory obligation.

 

9 YOUR RIGHTS

In addition to the right to know the information on this privacy notice, subjects also have the right to:

  1. Information on whether we have Personal Data relating to a subject, the categories of data and the purpose of processing.
  2. Access your personal data. Where you request information and the format is of the data is not reasonably understood, this shall be delivered in an intelligible format.
  3. Have inaccurate, incomplete or out-of-date personal data that we hold about you corrected or deleted.
  4. Withdraw consent for your personal data to be processes – where it was obtained from you on the basis of consent.
  5. Be informed if a failure to provide the personal data will have any direct and material personal consequences.
  6. Make a submission on any automated decisions making processes or profiling of you.
  7. At your request and under certain circumstances, to transfer your data to another controller.
  8. Have your personal data excluded from certain categories of processing.

– Real Nation will require proof of your identity prior to discussing or providing access to your personal data.

 

10 DATA RETENTION

We retain personal data that you submit to us only for as long as is necessary for the purposes for which it was obtained, or as required by law. Real Nation reserves the right to delete personal data prior to the conclusion of the retention period.
